1. Scope of Application and Contracting Party
These Terms and Conditions govern all purchases made through this online store. The store is operated from Switzerland by Evgen Smelyanskiy (Einzelfirma, CHE-192.677.429), Hardstrasse 39, 5430 Wettingen, Switzerland, email: info@nichehome.ch. A contractual relationship arises between the customer ("you") and the store operator ("we"). These Terms apply to all orders for delivery or pickup within Switzerland and Liechtenstein. By placing an order, you confirm that you have read and accept these Terms.
2. Products, Images, and Stock Availability
We strive to describe products as accurately as possible and provide up-to-date photos. However, minor differences in color, packaging design, or details are possible due to monitor settings, manufacturer changes, or lighting conditions. Product availability is not guaranteed until the order is confirmed. Adding a product to the cart does not mean the product is reserved or availability is confirmed. If after placing an order it turns out that a product is unavailable, we will promptly notify you and fully refund the cost of unavailable items.
3. Prices, Currency, and Taxes
All prices on the site are shown in Swiss Francs (CHF). Prices include all mandatory taxes (e.g., VAT) unless explicitly stated otherwise. Shipping costs are not included in the product price and are displayed separately during checkout before confirmation. If a shipping method involves additional costs, these costs will be shown before final order confirmation.
4. Delivery, Timelines, and Pickup
We deliver throughout Switzerland and Liechtenstein. Estimated delivery times are typically 2–5 business days but may vary depending on carrier workload, holidays, and other factors beyond our control. After the order is handed over to the postal or courier service, responsibility for any delays related to these services lies with the respective carriers. When selecting pickup, the product is prepared for collection at the selected branch. We will notify you by email and/or SMS when the order is ready for pickup. Pickup is provided free of charge.
5. Transfer of Risk
According to Art. 185 of the Swiss Code of Obligations (OR), the risk of accidental loss or damage to the goods passes to the customer at the time of delivery to the transport service (for delivery) or at the time of actual handover of the goods to the customer (for pickup).
6. Order Process and Contract Formation
When placing an order, you: (1) add products to the cart; (2) proceed to checkout; (3) enter your contact and address details; (4) select delivery or pickup method; (5) confirm acceptance of the Terms and Privacy Policy; (6) submit the order. After submitting the order, you will receive an automatic email confirmation of order receipt. This email confirms receipt of your order but does not guarantee availability of all products. The final contract is deemed concluded after we accept and process your order (e.g., confirm it and begin assembly/shipment).
7. Payment Methods
Available payment methods are displayed during checkout. We reserve the right to restrict available payment methods for individual orders or customers. If payment cannot be successfully processed, the order is automatically cancelled.
8. Returns, Exchanges, and Your Rights Under Swiss Law
Unlike EU legislation, Swiss law does not provide for a general automatic right of withdrawal and return of goods for online purchases (there is no guaranteed 14-day "right of return"). This means you cannot return a product without reason just because you changed your mind. We accept returns or exchanges only in the following cases: – the product has a manufacturing defect; – the product was damaged during delivery; – the wrong product was delivered; – for a specific product, the product page explicitly states voluntary return is possible. If one of these cases applies, you must notify us within a reasonable time, typically within 7 days of receiving the product, describe the problem, and provide photos if possible. We will provide you with return instructions. Products returned due to defect or incorrect delivery should generally be returned in original packaging and, as far as possible, in original condition, except where defect or damage prevents this. After receiving and inspecting the returned product, we may offer: – product replacement; – repair (if applicable); – refund of product cost. Refunds are made to the same payment method used for purchase unless otherwise agreed.
9. Warranty (Gewährleistung)
Warranty obligations are governed by the Swiss Code of Obligations (OR). The customer must notify us of a defect within a reasonable time after it is discovered. The warranty covers substantial defects that existed at the time of delivery to the customer. The warranty does not cover: – natural wear and tear; – damage caused by improper use or storage; – external influences beyond our control; – minor differences or imperfections that do not affect functional properties.
10. Limitation of Liability
We are not liable for indirect or consequential damages, lost profits, or delays caused by postal or courier services, to the extent permitted by applicable Swiss law. Our liability is limited to damage caused by intentional acts or gross negligence on our part.
11. Privacy and Data Protection
We process your personal data in accordance with the Swiss Federal Data Protection Act (revDSG), and where applicable, the General Data Protection Regulation (GDPR) for customers from Liechtenstein. Detailed information on the processing of personal data is set out in our Privacy Policy, which is an integral part of these Terms.
12. Intellectual Property
All texts, images, logos, design, and site structure are subject to copyright and other intellectual property rights. Any copying, distribution, or use of site materials without our prior written permission is prohibited.
13. Applicable Law and Jurisdiction
These Terms are governed exclusively by Swiss substantive law. The place of jurisdiction is Wettingen, Switzerland, unless otherwise provided by mandatory provisions of applicable law. If any provision of these Terms is found to be invalid or unenforceable, this does not affect the validity of the remaining provisions. We reserve the right to update and amend these Terms; the version in effect at the time of order placement applies.
